After a three-week bench trial in Santa Fe, the court determined that Facebook and Instagram constituted a public nuisance by worsening psychological distress among teenagers and neglecting to shield minor users from online dangers. The penalty will fund five years of specialized mental health treatments, early screening programs, and community outreach efforts.

    This latest financial ruling follows a previous $375 million jury verdict against the company in March 2026, during the initial phase of the state’s legal proceedings. In that case, jurors found that Meta violated New Mexico consumer protection laws through false claims about product safety for younger users. Combining both rulings, Meta faces a total liability of $942 million from the state enforcement action led by New Mexico Attorney General Raúl Torrez, with the $567 million allocated for teen mental health funding.

    The detailed remedial order issued by the court stipulates that $420 million of the newly awarded funds will directly finance clinical mental health services for children across New Mexico. The remaining funds are designated for public education campaigns, early screening initiatives, and community prevention programs over the next five years. The ruling also enforces strict operational requirements for Meta, including the implementation of default private settings for accounts of users under 18, limiting daily engagement, restricting notification pushes, and enhancing screening for child sexual abuse material.

    This enforcement action by Mexico is among the largest penalties imposed on a major tech company over child safety practices. Attorney General Torrez initiated the lawsuit following investigations by state prosecutors, which alleged that Meta’s algorithmic recommendation systems systematically exposed minor accounts to predatory contacts and explicit material. While requiring substantial product modifications, Judge Biedscheid chose not to require mandatory identity verification for users under 13, citing protections under the Children’s Online Privacy Protection Act.

    Meta’s corporate representatives stated after the court session that the company plans to appeal the verdict to higher state courts. In an official statement, Meta highlighted its investments in developing age-appropriate features, parent supervision tools, and automated content moderation across its platforms. Company officials argued that the ruling misinterprets platform design and overlooks the internal engineering efforts dedicated to removing harmful content and identifying malicious actors on social networks.

    Judge Calls for Funds to Support Prevention and Early Detection Programs

    This judicial decision comes amid increasing legal scrutiny faced by social media companies in both federal and state courts across the United States. Over 40 state attorneys general, along with hundreds of local school districts, have initiated parallel lawsuits claiming that platform design choices foster addictive usage patterns among teenagers. The New Mexico ruling sets an important legal benchmark as other states continue their cases towards trial in federal courts later this year.

    As Meta prepares for appellate review of the $567 million payment allocated for teen mental health programs, state officials are examining ways to distribute the proceeds from the trial. New Mexico authorities indicated that funds will prioritize rural healthcare access, behavioral health services, and school-based health facilities. The court-mandated structural remedies are scheduled to remain in effect for five years, pending the outcome of Meta’s appeal.
